Can I get a worldwide trade mark?
There is no single trade mark registration which covers every country in the world, and this is likely to be the case for the foreseeable future.
Each country has its own trade mark system and registry: e.g. the UK registry is based in Newport (South Wales), the Irish registry is in Kilkenny, the US registry is headquartered in Virginia. Each registry has its own pricing and examination systems. On the whole, all trade mark registries conform to broadly the same principles.
However, there are a number ways and strategies for protecting trade marks. For instance, if your company sells its products throughout the EU, you may wish to apply for an EU trade mark registration. One trade mark registration covers all 28 member states (at the time of writing) of the EU. Negotiations are on-going as to the impact of Brexit on the EU trade mark registration. It is something that we monitor closely here at Trade Mark Associates.
Similarly, there is a system from the United Nations which allows applications to be filed in 102 countries in the world. Countries party to this agreement include the USA, the EU, China and India. The system is very popular with trade mark owners, due to it being highly cost effective. However, there are a number of countries that are not party to the agreement, notably the UAE, Canada, Hong Kong and Taiwan. Although, it is not always the most time efficient system to use, the financial savings can be huge when utilised correctly.
